Vietnam – Technical Regulation on Safety of Toys Approved

The Minister of Science and Technology of Vietnam has approved QCVN 3:2019/BKHCN Technical Regulation on Toy Safety. It shall be effective on 1 January 2021, when the previous Technical Regulation of Toys will be revoked.

Toys that are used by children under 16 years of age must comply with the following requirements:

1. Toys must comply with physical requirements and flammability mentioned in TCVN 6238-1:2017 (equivalent to ISO 8124-1:2014) and TCVN 6238-2:2017 (equivalent to ISO 8124-2:2014) respectively.
2. Toys must comply with the following chemical requirements:
   1. Toys must comply with the requirements of the migration of the certain elements, according to TCVN 6238-3:2011:

   2. Liquids that are exposed in children’s toys shall not have a pH value less than 3.0 or greater than 10.0.
   3. Requirement for formaldehyde in toys intended for children under 3 years:
      1. The content of formaldehyde in accessible textile components ≤ 30 mg/kg.
      2. The content of formaldehyde in accessible paper components ≤ 30 mg/kg.
      3. The release of formaldehyde by accessible resin-bonded wood components ≤ 80 mg/kg.
   4. Phthalates
      

      	Limit	Application
      Bis(2-ethylhexyl) phthalate (DEHP)	≤ 0.1%	Applicable for all toys
      Dibutyl phthalate (DBP)
      Benzyl butyl phthalate (BBP)
      Di-isononyl phthalate (DINP)	≤ 0.1%	Applicable for toys that can contact mouth
      Di-isodecyl phthalate (DIDP)
      Di-n-octyl phthalate (DNDP)

   5. Aromatic amines in toy materials shall be ≤ 5 mg/kg.
3. The operating electricity power shall not exceed 24 V, and the voltage of components of the toy that contact the power source shall not has nominal or instantaneous voltage exceeding 24 V.
4. Labelling must comply with the requirements of Decree No. 43/2017/ND-CP.
5. Declaration of conformity for domestically manufactured toys must be issued.
6. Imported toys must be registered for state inspection of quality.
7. Toys must undergo conformity assessments with certification under Mode 5 or Mode 7. The certificate shall be valid for not more than 3 years.
8. Toys that comply with this Technical Regulation must carry the required conformity mark.
9. Toy that are tested and comply with the previous Technical Regulation before 31 December 2020 can be sold in the market until 31 December 2021.
