Canada – Amendment to Textiles Labeling and Advertising Regulations Proposed

The Competition Bureau of Canada is proposing to revise the Textiles Labeling Act (TLA) and Textiles Labeling and Advertising Regulations (TLAR) to amend the scope of labeling requirements for upholstered and filled articles, along with streamlining those requirements for simplification.
Following are the proposed revisions:
- The provincial exemption under section 10 of the TLAR would be simplified to exempt only fiber-related label representations that are required by provincial law
- Upholstered and stuffed articles:
- Harmonize section TLAR 37 and 38(1) regarding the disclosure of filling materials for upholstered and stuffed articles, simplifying the requirements
- Repeal TLAR subsection 38(2), hence requiring disclosure of filling or stuffing for upholstered furniture, mattresses, box springs, cushions, chair pads, potholders, oven mitts, place mats, and mattress protectors
The proposal is to ensure a consistent labelling regime for all upholstered and stuffed articles that will help to ensure that all Canadian consumers, even those outside Quebec, have all the necessary information to make informed purchasing decisions.. - Amend TLAR to allow for non-permanent labels to disclose all textile components of TLAR subsection 38(2) articles
- Effective date: proposal is to have effective date at least 12 months after implementation, requiring the upholstered and filled articles manufactured after that date to meet the requirements.
