The State of Utah has published a draft of its new rule change governing the online sale of stuffed articles, open for public comment until August 14, 2024. If unchanged, the rules will take effect on August 21, 2024, with enforcement beginning April 1, 2025.

It is imperative to note that these rule changes specifically target online sales, while physical law labels remain a requirement for products.

The proposed rules introduce new labeling requirements for online sales of:

  • Bedding and furniture
  • Quilted clothing articles

The public is invited to review and provide feedback on the proposed rules before the August 14 deadline.

By April 1, 2025, online retailers selling stuffed articles that can be shipped to Utah must provide specific product information to consumers before purchase. This information must be:

  • Displayed directly on the product page
  • Hyperlinked to an approved third-party website

Acceptable formats for this information include:

  • Digital law labels or textile labels (images)
  • Text

Retailers must ensure this information is easily accessible to consumers on their product pages to comply with the new regulations.

Specific information appropriate to the product category must be displayed.

Bedding and Furniture digital law labels must include:

  • Filling materials
  • URN (Unique Registration Number)
  • Sterilization permit number (if applicable)

Quilted Clothing digital textile law labels must include:

  • Filling materials
  • RN/WPL (Registration Number/Wool Products Label) - must match Utah registration information
  • Sterilization permit number (if applicable)

Made-to-Order (MTO) Exemption:

The State of Utah defines MTO as “a manufacturing process of upholstered furniture in which the production of an item begins after a consumer or retailer places an order and includes articles with consumer options that could impact the final law label.”

This applies to products ordered in a physical store.

Displaying Required Information:

The required information must appear on product landing page, in one of two formats given below:

Option #1: Directly on the page (e.g., product description, specifications, image carousel)

(OR)

Option #2: Hyperlinked to an approved third-party website (for convenient management)
