Utah’s Change in Proposed Rule for Online Requirements

As of March 1, 2025, the State of Utah’s Change in Proposed Rule (CPR) to the R70-101 has put a temporary pause on online labeling requirements for bedding, upholstered furniture and quilted clothing, which were initially set to take effect on May 15, 2025. Utah will take a 30-day waiting period to decide the next course of action. Until further action is taken, retailers can disregard the previously stated May 15, 2025 enforcement date for online sales requirements.

The Department of Agriculture and Food is proposing to align the rule with the legislature's clarification of the Title 4, Chapter 10, Bedding, Upholstered Furniture, and Quilted Clothing Act, which excludes online sales from regulation. The proposed changes remove references to online sales (including previous definitions related to bedding, upholstered furniture, and quilted clothing).

The original proposed amendment upon which this change in proposed rule (CPR) was based was published in the January 1, 2025, issue of the Utah State Bulletin.  The CPR (from page 81 onwards) and the proposed amendment (from page 7 onwards) must be viewed together to understand all of the changes that will be enforceable should the agency make this rule effective. Underlining indicates text that has been added, and strike-out indicates text that has been deleted.

There is a public comment period until March 31, 2025, and after review, the rule may come into effect on or after April 7, 2025.
